General Terms and Conditions and Cancellation Policy

Orders to be shipped to Germany, Austria and Switzerland

Breitkopf & Härtel (B&H) ships to Germany, Austria and Switzerland only through specialist retailers and therefore passes orders from customers in these countries to the relevant retailer selected by the customer. For this reason a purchase contract is concluded between the customer and the retailer selected, subject to the terms and conditions of the retailer in question. B&H does not accept any responsibility for these contracts.

Orders to be shipped to countries other than Germany, Austria and Switzerland

Conclusion of contract: By completing the ordering process on our internet homepage, a binding purchase contract is concluded between the customer and Breitkopf & Härtel (B&H).

Shipment: Goods are shipped ex B&H warehouse to the address specified by the customer, and at the expense and risk of the customer. Delivery dates or periods quoted by B&H are for guidance purposes only and not binding. If a title is unavailable, the customer will be informed immediately by return mail. In that case, B & H is entitled to withdraw from the contract.

Due date and payment of purchase price: The purchase price becomes due at the time B&H ships the goods. Payment is always made by debiting the customer's credit card.

Retention of title: The goods shipped remain the property of B&H until all amounts receivable from the customer have been paid in full.

Guarantee: In line with statutory guarantee obligations, B&H guarantees the goods ordered against defects. B&H does not accept liability for damage not caused to the object supplied itself, i.e. consequential loss, lost earnings or other damage to property.

Data protection: B&H only records data that is necessary for performing the order and keeps this data in line with statutory preservation requirements. Data is transferred to third parties only if this is necessary to process the order.

Applicable law: All shipments are made on the basis of these general terms and conditions. Different terms and conditions of the customer are applied only if B&H has agreed to them in writing. Contracts are subject to the laws of the Federal Republic of Germany excluding the UN Convention on Contracts for the International Sale of Goods (CISG)

If a provision of these general terms and conditions is ineffective, this does not affect the validity of the other provisions.

Cancellation Policy for Consumers with a domicile and a place of delivery in a country of the EU

Right of Revocationy
Purchasers, who are consumers, are entitled by applicability of the regulations for distance contracts to a right to revoke the contract on condition of the following instructions: Purchaser may revoke the order within a revocation period of one month without further specification of reasons in written form (e.g. letter or e-mail) or by returning the goods. The revocation period does not start before the delivery and the reception of this instruction. Punctual dispatch suffices as compliance with the time limit. The revocation must be declared to:

Consequences of revocation
In case of an effective revocation, any performance received by one party is to be returned to the respective other, as are benefits derived from such performance, e.g. interest. If Purchaser cannot return the goods received in whole or in part, or if Purchaser can only return the received goods in a deteriorated state, Purchaser must pay compensation for value insofar. There is no obligation to pay compensation for value if the sole cause of deterioration of the good(s) received was the inspection of the respective good(s), as would have been possible in a retail shop. For the rest, Purchaser can avoid paying compensation for value in respect of deterioration in the good(s) as a result of their/ its proper use, if Purchaser does not use the good(s) the way Purchaser uses Purchaser's own property and refrain from doing anything that would curtail the value of the good(s). If the value of the order does not exceed Forty Euros (EUR 40) and the good(s) delivered correspond to the good(s) Purchaser ordered, Purchaser must bear the costs of return. If Purchaser is an EU-resident and if the value of Purchaser's order exceeds Forty Euros (EUR 40) the costs of return will be borne by Breitkopf & Härtel. Obligatory refunds of payments must be made within 30 days after sending the revocation or returning the goods.
Notice: Purchaser's Right of Revocation shall expire prematurely if the contract has been completely fulfilled at the specific request of both parties before Purchaser has made use of his/her Right of Revocation. This concludes this statement of the rights of Revocation.

Widerrufsbelehrung für Verbraucher mit Wohnsitz und Lieferanschrift in einem EU-Land

Widerrufsrecht

Sie können Ihre Vertragserklärung innerhalb von einem Monat ohne Angabe von Gründen in Textform (z.B. Brief, Fax, Email) oder – wenn Ihnen die Sache vor Fristablauf überlassen wird – durch Rücksendung der Sache widerrufen. Widerrufsfolgen:

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit gegebenenfalls Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung – wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre – zurückzuführen ist. Im Übrigen können Sie die Pflicht zum Wertersatz für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung vermeiden, indem Sie die Sache nicht wie Ihr Eigentum in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Bitte beachten Sie: Das Widerrufsrecht besteht nicht bei Waren, die nach Kundenspezifikation angefertigt worden oder eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind oder die aufgrund ihrer Beschaffenheit nicht für eine Rücksendung geeignet sind. Das Widerrufsrecht besteht außerdem nicht bei Fernabsatzverträgen zur Lieferungen von Audio- oder Videoaufzeichnungen oder von Software, sofern die gelieferten Datenträger vom Verbraucher entsiegelt worden sind.
